ILC Czechoslovakia, s.r.o.

OPERATOR

ILC Czechoslovakia, s.r.o.  IČ 47907142, DIČ CZ47907142, registered office
Prokofjevova 2, 623 00 Brno (hereinafter the Seller), operates
the following Conditions of Trading with its customers (hereinafter Buyers):


PRICES

Prices include value added tax but cannot always be updated to include
a rate of value added tax coming into force after the Buyer has
ordered but before the transaction has been completed.

ORDERS

Orders processed by the e-shop are regarded as firm orders and as such
are subject to the provisions of § 409-470 of the Commercial Code relating
to contracts entered into. Goods ordered remain the property of the Seller
until such time as they have been paid for in full by the Buyer.

PAYMENT AND DELIVERY

Regular customers have contractual terms of payment and delivery.
Consigments to schools and companies are dispatched by courier, and
these recipients are expected to provide a delivery address where
goods can be delivered throughout the working day, unless specific
alternative arrangements have been made in advance.

Cash on Delivery
Buyers without contractual terms of payment and delivery will receive
goods Cash on Delivery (C.O.D.), by courier if they are normally available to
take delivery at the address provided, by post for collection if not.
Orders over 3000,- Kc are delivered free.

Collection in Person
Trade customers, schools and teachers registered with ILC have the option
of collection their goods in person at the ILC warehouse in Brno. You will
be notified when goods are ready for collection. For large orders and during
the high season (September) you should arrange a collection time in advance to
avoid delays. Orders may be collected on weekdays between 8:00 and 16:00.

Payment
Payment can be made C.O.D., or when collecting goods in person in cash.
Customers with contractual payment terms will be invoiced for goods
irrespective of delivery or collection.

DATA PROTECTION

The Seller undertakes to use personal data only for the purposes of
completing transactions entered into with Buyers or to make such offers
to its customers as regulations currently in force permit. No such data
will be published or passed on to third parties other than the usual
details which are supplied to shippers in connection with delivery or
information provided for purposes of account keeping and taxation records.

If you have any reservations with regard to use of your personal details
you should send them in writing to ILC Czechoslovakia, s.r.o., Řípska 15a,

WITHDRAWAL FROM THE CONTRACT

The Buyer is entitled to withdraw from a contract entered into through
the e-shop within 14 (fourteen) days of delivery of the goods and to return the
goods without giving a reason and without sanctions, in which case the Seller will
reimburse the full amount paid for the goods within 30 days of the Buyer's withdrawal
from the contract. The Seller will remit such amounts by bank draft or postal order.
This right to withdraw from the contract does not apply to orders for goods which
have to be specifically ordered by the Seller for the customer and which are denoted as such
in the e-shop.

On withdrawal from the contract the Buyer shall return the goods by post or courier
or in person to ILC Czechoslovakia, s.r.o., Řípska 15a,
627 00 Brno (Slatina). A copy of the invoice must be included.
The goods must be undamaged and fit for sale to another customer
(i.e. not written in, etc.). They must be returned within 14 days
of receipt. In the case of audio and audiovisual media and software
the original packing must be intact in order for the Buyer to retain
the right to withdraw from the contract.

The Seller reserves the right to cancel an order from the e-shop
in case the goods are no longer in production or otherwise not
available, in which case the Seller will immediately contact the Buyer
to agree on a course of action.

GUARANTEE

The Seller guarantees the goods for a period of 24 months, excluding
normal wear and tear, damage resulting from mishandling the goods after
their delivery to the Buyer, and Act of God. This guarantee period may
be specifically extended for some types of goods.

CLAIMS

Any claims relating to damaged or unsuitable goods are subject to the provisions
of the Civil Code and the Consumer Code. Where the goods are irreparably damaged
or defective they will be exchanged or their cost refunded. Claims should be
made in writing (including email) with a description of the shortcoming. Further
action will be taken after an assessment of this information. If the claim
is accepted by the Seller, the Buyer shall send the goods together with their
original packaging where applicable, and the Seller will dispatch or otherwise
deliver a replacement within the period determined by current regulations as soon
as it is available from the manufacturer or other supplier, or the whole of the
amount paid for the original goods, including freight, will be refunded.
Production and print defects (printer's errors, missing pages, faulty
recordings, etc.) can be claimed on within 24 months of the invoice date.
Claims for supply of goods other than those ordered will be dealt with on a similar basis.

Goods subject to claims as set out above should be sent or taken to the
above address, and the Buyer will be informed when the replacement goods
are ready for collection, or dispatch them to the Buyer.

Unless otherwise agreed the Buyer will bear the cost of returning the goods.
Where goods have been returned as unsuitable through damage or defect as
set out above, the Buyer may request that the Seller refund such cost.


The cost of supplying replacement goods will be borne by the Seller.

Claims will be dealt with by the Seller within 30 days of their receipt.

Where goods are delivered to the Buyer in a damaged condition or
incomplete the Buyer should proceed as follows:

Where damage to packaging is evident, the Buyer should bring this to
the attention of the carrier and make a written note of the fact.

Where damage or other shortcomings become evident only after unpacking
the goods the Buyer should inform the Seller immediately by email
to shop@ilc.cz or by telephone on 545 215 669, giving details of the problem and
their contact details, and identifying the documents accompanying the delivery,
provided these are not themselves missing. This should be done within 3 working days.

The above conditions apply as of 1st April 2014 until revoked.
By sending an order the Buyer confirms that he/she has
read these conditions of trading and agrees to them.
All matters not specifically dealt with in the conditions
of trading shall be governed by the regulations currently
in force in the Czech Republic.
